Terms of Service

1. Agreement
These Terms of Service govern your use of getmapai.com and the MapAI natural-language geospatial query platform (together, the "Service") operated by MapAI Pty Ltd ("the Company") (120 Collins Street, Level 20, Melbourne VIC 3000, Australia). By creating an account or otherwise using the Service you accept these Terms. Nothing in these Terms limits your statutory rights under the laws of your country of residence.
MapAI is a platform that converts plain-language geographic queries into interactive maps by processing your queries against publicly available and licensed geospatial datasets. These Terms describe the rules that apply to that use.
2. Use of the Service
- You must be of legal age in your jurisdiction to enter contracts, or have parental or guardian consent, to use the Service.
- You agree not to use the Service for any unlawful purpose, to interfere with its operation or security, or to attempt to gain unauthorised access to any system or data.
- You may not scrape, reverse-engineer, decompile, or copy any part of the Service except as expressly permitted by these Terms or by mandatory applicable law.
- You may not use the Service to generate, store, or distribute content that is illegal, defamatory, or infringes any third-party right.
- The query limit applicable to your subscription plan applies to automated use as well as manual use; you may not use the API or any automated process to circumvent plan limits.
3. Intellectual Property
The Service, including the natural-language query engine, map rendering technology, data layer integrations, and all associated software, is owned by the Company or its licensors and is protected by international intellectual property law. We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose during the period your subscription or free plan remains active.
Map results generated by your queries are provided for your use under the terms of the relevant underlying data licences (primarily Australian open government data licences). The Company makes no claim to ownership of the geospatial datasets themselves.
4. User Content
You are responsible for any content you submit to the Service, including natural-language queries, custom data layers, and CSV uploads. You represent that you have the right to submit this content and that doing so does not violate any law or third-party right.
You grant the Company a limited licence to use, store, process, and display your submitted content solely to provide the Service to you. Your query content and uploaded data layers are private to your workspace and are not used to train the Company's machine learning models without your explicit written consent, and are never shared with other users or organisations.
5. Disclaimers
The Service is provided on an "as is" and "as available" basis. Map results are generated from publicly available and licensed geospatial datasets; the Company does not warrant the accuracy, completeness, or currency of any geospatial data or query result. You should verify any result that is to be relied upon for significant decisions.
To the maximum extent permitted by applicable law, the Company disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Mandatory consumer warranties applicable under Australian Consumer Law or the laws of your country of residence are not affected by this disclaimer.
6. Limitation of Liability
To the maximum extent permitted by applicable law, the Company's total liability for any claim arising from or related to the Service will not exceed the greater of AUD 100 or the subscription fees you paid to the Company in the three months preceding the claim. This limitation does not apply to liability that cannot be limited under mandatory law, including liability for death or personal injury caused by negligence, or liability under the Australian Consumer Law for non-excludable consumer guarantees.
7. Indemnification
You agree to indemnify and hold harmless the Company from any claims, losses, damages, costs, or expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any third-party right, including any data rights relating to content you submit.
8. Subscription and Billing
Paid plans are billed monthly or annually as selected at checkout. You may cancel your subscription at any time; your access continues until the end of the current billing period. The Company reserves the right to adjust pricing on 30 days' notice. Free plan users may have their accounts deactivated after a period of extended inactivity.
9. Termination
The Company may suspend or terminate your access to the Service for material breach of these Terms, with notice where practicable. Upon termination, sections of these Terms that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of Australia.
Disputes arising under or in connection with these Terms are subject to the non-exclusive jurisdiction of the competent courts in Melbourne, Australia, without prejudice to any mandatory consumer-protection rights you hold under the laws of your country of residence.
11. Changes and Contact
The Company may update these Terms from time to time. Material changes will be communicated by posting a revised version at this URL with a new "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
